Present and future losses

You get claim compensation for:

  • Present losses – You can claim for how your injury affects you now, and up to the court date. For example, you can claim for immediate costs that you have incurred, such as medical and other expenses, and for the pain and suffering you have been through.
  • Future losses – You can claim for how your injury will affect you in the future. For example, you can claim for your loss of ability to do certain activities that you could do before you were injured, also referred to as ‘loss of amenity’. Loss of amenity can include things such as loss of mobility and loss of ability to do recreation and leisure activities you used to do. If your ability to work has been affected, you can also claim for future loss of earnings.
